The incident created a furor in Quebec's National Assembly and made headlines around the world after then education minister Yves Bolduc defended the strip search, saying it was acceptable as long as it was done in a \"respectful manner.\"
The mother added she's glad to hear the provincial government will be reviewing its policies on strip searches at high schools because it doesn't seem possible to her that such searches could be legal.
The teen says that during the incident, the principal and another female school staff member told her to remove her clothes behind a screen, including her bra and underwear, and pass them over so they could look for the pot.
Quebec Premier Philippe Couillard said Thursday in the National Assembly that there is \"no question\" that strip searches \"should not happen\" in Quebec schools. But he added he needs to know all the facts about this case.
\"I want to know exactly what happened in that particular school. Was there a strip search Was there this type of intervention that has been reported in the media, yes or no We need to understand this and we have to show a minimum of judgment here,\" he said.
The issue of strip searches in schools is not specifically mentioned in the guidelines. But they note that the Supreme Court decided that students cannot expect a full protection of their privacy while in school.
The Parti Quebecois says despite the high court's rulings, the Liberals should ban strip searches outright. At the very least, it should be made clear that no such search take place without parental consent.
While the Supreme Court in M.(M.R.) did not specifically address whether, or when, a school could conduct a strip search of a student, it provided a list of factors to consider in determining whether a search was reasonable.8
In a 2001 decision, R v. Golden, the Supreme Court of Canada provided guidelines for how police should conduct strip searches in accordance with the Canadian Charter of Rights and Freedoms.9 While that case was in the context of police operating in the field, the Court stated that it was best to conduct searches at a police station except in the most exigent circumstances.
The Board also relied on M. (M.R.) in its justification for the strip search of the Neufchâtel student. The Board concluded its statement by saying that the situation at Neufchâtel was exceptional, but nonetheless was conducted under established guidelines. The Board, however, undertook to review its policies in order to make any necessary changes.
Given the principles articulated by the Supreme Court of Canada in M. (M.R.) and Golden, personal searches of students, but not strip searches, likely continue to be appropriate where reasonable grounds exist. Police should be contacted where a strip search is believed to be necessary, particularly in the context of a student suspected of trafficking drugs or possessing weapons.
